Terms of sale

1. Purpose

These terms of sale apply to subscriptions to the paid plans of the Expansel service, in addition to the terms of use. They are accepted by ticking a box before each payment; the accepted version (its date) is kept with the order.

2. Who sells

The service is provided by the publisher of Expansel (see the legal notice). The sale is made by Polar Software, Inc. ("Polar"), acting as reseller and merchant of record: Polar collects the payment, issues the invoice and collects applicable taxes. Polar's purchase terms apply to the payment itself. We never have access to your card details.

3. Plans and prices

Plans, their limits and their prices are described on the pricing page and repeated before payment. There are two billing options:

  • Monthly: a subscription paid every month, renewed automatically until cancelled;
  • Yearly: twelve months paid at once, at a reduced rate, with no automatic renewal.

Prices include taxes. The VAT amount depends on your country and is calculated by Polar. A business can enter its EU VAT number at checkout; where VAT is not due (reverse charge), it is not charged. The Enterprise plan is subject to a separate quote and contract.

4. Ordering

You choose your plan and billing option in your account, accept the terms of sale and ask for the service to start immediately, then pay on Polar's secure page. The plan is activated as soon as the payment is confirmed, usually within moments. The invoice is sent by Polar and remains available in the billing portal.

5. Payment and incidents

The monthly option is charged on each renewal date. If a charge fails, Polar retries the payment over several days; your plan remains active in the meantime. If the payment does not succeed, the subscription ends and the account returns to the free plan. You can update your card from the billing portal.

6. Term, renewal and cancellation

Monthly option. It renews every month. You can cancel it at any time, in a few clicks, from the "Subscription" page of your account. Cancellation takes effect at the end of the period already paid: you keep your plan until then, and nothing more is charged. Until that date, you can undo your cancellation in one click. An email reminds you of the end date seven days and one day before.

Yearly option. It covers twelve months from its start and does not renew: nothing is charged at its end. We notify you by email thirty, seven and one day before it expires. Without a new purchase, the account then returns to the free plan. A year bought before expiry is added to the current one.

7. Changing plan

Time already paid is never lost.

  • Monthly, to a higher plan: the change is immediate; the price difference until the next renewal is charged the same day, prorated.
  • Monthly, to a lower plan: the change takes effect at the next renewal; nothing is charged or refunded, and you keep the current plan until then. You can cancel the change before its date.
  • Switching to a year: the monthly subscription is stopped upon payment, with no further charge, and the days already paid are kept. For the same plan, the year starts at the end of the paid month. To a higher plan, it applies immediately and the remaining days of the lower plan are converted in proportion to the price. To a lower plan, you keep the current plan until the end of the paid time, then the year starts.
  • During a running year: the same rules apply when buying a new year. A monthly subscription cannot be taken out while a paid year is running.

If your usage exceeds the limits of the new plan, no content is deleted, but additions are blocked beyond the limits and features reserved for the higher plan are no longer available.

8. Right of withdrawal (consumers)

If you are a consumer, you have fourteen days from subscription to withdraw, without giving any reason. To exercise it, send an unequivocal statement to contact@expansel.com, for example: "I hereby give notice that I withdraw from the contract for the Expansel [plan] subscription, taken out on [date], by [name, account email address]."

By ticking the box provided before payment, you expressly ask for the service to start immediately. If you withdraw, you owe an amount proportional to the service provided until you communicated your decision; the balance is refunded by Polar, using the payment method used, no later than fourteen days after receipt of your request. Access to the paid plan ends upon refund.

The right of withdrawal does not apply to businesses.

9. Refunds

Apart from withdrawal, amounts paid for a period that has started are not refunded, unless we fail to perform or the law provides otherwise. Any refund is made by Polar. A full refund of a year removes the access it had opened, for the part not yet elapsed. A refund made to prevent or settle a chargeback may end the subscription concerned.

10. Deleting your account

Deleting your account immediately stops the running subscription, with no refund of the period started; a paid year ends in the same way. If you want to keep the service until the end of the paid term, cancel your subscription instead and delete your account afterwards.

11. Price changes

We may change our prices. An increase never applies to a period already paid; for a running monthly subscription, it is announced at least thirty days in advance and you can cancel before it applies.

12. Statutory guarantees

Consumers benefit from the statutory guarantee of conformity for digital content and services. Any lack of conformity can be reported to contact@expansel.com.

13. Customer service and complaints

For any question about the service: contact@expansel.com. For a question about a payment or an invoice: Polar's billing portal, accessible from your account.

14. Mediation

If a dispute with our customer service remains unresolved, a consumer may use the consumer mediator free of charge: [to be completed: name, address and website of the consumer mediator].

15. Governing law

These terms are governed by French law; the French version prevails. A consumer keeps the protection of the mandatory rules of their country of residence and may bring proceedings before the courts of their domicile.
